The challenge
Few types of information are as consequential as health information. Informed-consent materials and patient information fulfil their purpose only when every patient can read them independently, including people with visual impairments, screen-reader users and people with limited reading ability. An inaccessible PDF excludes precisely those who most depend on clear health information.

Legal framework
- BFSG / European Accessibility Act for private institutions
- The German Accessibility Strengthening Act (BFSG) implements the European Accessibility Act (EAA) in German law and has applied since 28 June 2025. It applies to private healthcare providers where they offer services to consumers electronically, such as patient portals, online appointment booking or electronic document delivery. PDFs that form part of such a service must be accessible.
- BITV 2.0 and Directive (EU) 2016/2102 for public-sector bodies
- Public-sector bodies – including university hospitals, municipal hospitals, public health authorities and statutory health insurers as social security bodies – must provide accessible file formats such as PDF under BITV 2.0 and Directive (EU) 2016/2102. This obligation applies independently of the BFSG.
- EN 301 549, WCAG 2.2 and PDF/UA-2
- Technical requirements are defined by the European standard EN 301 549, WCAG 2.2 and the PDF standard PDF/UA-2. Accessful audits and remediates documents against these standards and provides an audit-ready report for every document.
- GDPR: health data under Article 9
- Health data is a special category of personal data under Article 9 GDPR. For remediation, documents are processed in ISO/IEC 27001-certified data centres in Germany; where stricter requirements apply, Accessful can run entirely on premises in your own infrastructure.

How is patient data protected during processing?
Documents are processed in ISO/IEC 27001-certified data centres in Germany. Where an organisation’s policies prohibit external processing, Accessful runs entirely in its own infrastructure – optionally air-gapped and using its own AI models – so health data remains within the organisation. Do informed-consent materials and consent forms remain unchanged after remediation?
Yes. Content and appearance remain unchanged. Accessful adds only the structural layer – tags, reading order and alt text. For digitally signed documents, schedule remediation before signing, because the document must be signed again after any subsequent change.
Does the BFSG apply to hospitals and medical practices?
The BFSG does not apply indiscriminately to every healthcare provider. It covers services offered to consumers electronically, such as patient portals and online appointment booking together with the documents provided through them.
